Ad Valorem Tax Foreclosure Sale
Section 51.002 of the Texas Property Code governs the trustee’s foreclosure sale under the power of sale provided under the deed of trust or other contract liens. The Foreclosure sale must be between 10:00am to 4:00pm of the first Tuesday of each month. The sale must start at the time stated in the notice or no later than 3 hours thereafter. To stop the sale, other than seniors 65 years old and over, the owner of the real property must make payments in full, including ad valorem tax, penalties, and costs prior to the sale of the property by tender cash or its equivalent to the trustee. Notwithstanding other type of foreclosure sales, prior to the ad valorem tax foreclosure sale, Section 51.002 of the Texas Property Code requires the trustee to provide notice to the owner and the mortgage company, through its mortgage servicer or original lender, at least 21 days prior to the sale via certified mail return receipt. The 21 days start on the date in which the notice was deposited in U.S. post office but does not include the day of the sale. Notice of the sale, which may also include an affidavit of the trustee acknowledging the effect that the service was completed, will be filed in the county clerk’s office.
